Kihei woman sentenced in burglary

WAILUKU – A judge told a Kihei woman she needed to end her “obsessed behavior” involving her ex-husband, as she was sentenced May 1 for entering his home and breaking his television last year.

Kyra Frate, 26, was given a chance to keep convictions off her record if she follows court requirements for the next five years.

She had pleaded no contest to first-degree burglary and third-degree criminal property damage in the Nov. 19 incident.

That afternoon, Frate went to her ex-husband’s residence on Kaiola Place and entered the home uninvited, police said. She went into the bedroom, where he was watching television with a friend and got into an argument, throwing the television and breaking it before he got her out of the room, police said.

She hit him and bit him on the arm before going outside, grabbing a broom and striking him on the chest and back, police said.

Officers responding to the home saw Frate punching her ex-husband in the face, causing a laceration on his lower lip, as he tried to keep her out of the residence, police said.

He declined treatment for abrasions to his chest, left shoulder and neck, as well as bruising and swelling to his lower back.

A plea agreement between the defense and prosecution called for no jail for Frate, who is set to receive an associate’s degree from the University of Hawaii Maui College, said Deputy Public Defender William “Pili” McGrath.

Frate said she had learned from the experience.

“I’m willing to do whatever it takes to make my life right, especially for my son,” she said.

Second Circuit Judge Rhonda Loo said she realized Frate was upset that day because her ex-husband wasn’t returning her phone calls. But there was “no way your behavior should be anywhere near this level,” Loo said.

“It almost sounded like you were obsessed with him,” Loo told Frate. “You guys are exes for a reason. You need to extract yourself from this situation.

“If you truly want to make yourself better, you’ve got to get rid of this obsessed behavior,” Loo said.

She ordered Frate to participate in a domestic violence intervention program and to complete 200 hours of community service within two years. Frate was ordered to comply with a temporary restraining order her ex-husband filed against her.
