Front St. off-limits after arrest

WAILUKU – A Lahaina man has been ordered to stay away from a portion of Front Street in Lahaina after he was arrested for allegedly selling drugs near Banyan Tree Park.

During his arraignment Wednesday in 2nd Circuit Court, Jon Eric Phoenix, 43, pleaded not guilty to charges of promoting a controlled substance in or near a park, school or school vehicle and possessing drug paraphernalia.

Phoenix, who is also known as Jonny Phoenixx, was arrested Sept. 17 when police saw him engaged in what was believed to be a drug transaction at Banyan Tree Park, said Deputy Prosecutor Tracy Jones.

She said Phoenix had bags of marijuana for sale for $20 and told police he had sold about four bags the night before. Phoenix also reportedly had sold two other bags of marijuana in the parking lot of Moose McGillycuddy’s in Lahaina, Jones said.

Phoenix had posted $5,000 bail to be released on the charges.

As part of his bail, Phoenix was ordered to stay away from Front Street between Cheeseburger In Paradise and King Kamehameha III School.

Phoenix said he agreed with the requirement.

Judge Rhonda Loo also ordered Phoenix not to consume alcohol or illegal drugs, including medical marijuana.

His trial is set for Jan. 13.
