Kihei man serving in jail for assault on girlfriend
WAILUKU – A Kihei man was taken into custody Tuesday to serve a two-month jail term for assaulting his former girlfriend by throwing a piece of furniture at her last year.
Tyson Aviles, 29, also was placed on one year’s probation.
Originally charged with abuse, he had pleaded no contest to an amended charge of third-degree assault.
The incident was reported at about 11 p.m. May 27.
Deputy Prosecutor Jeffery Temas said Aviles “could not control his behavior, could not control his alcohol consumption or his anger,” when he started arguing with his girlfriend. The two have a child together.
“Defendant’s anger escalated into violence when the complaining witness decided to leave, with this defendant punching furniture, then picking up an armoire and throwing that at the complaining witness, causing her minor injury,” Temas said.
As part of his sentence, Aviles was ordered not to consume alcohol or illegal drugs and to complete a domestic violence intervention program.
Second Circuit Judge Joseph Cardoza followed a plea agreement in sentencing Aviles.
Cardoza said he would consider releasing Aviles from jail sooner if he enters substance abuse treatment.
