Capobianco agrees to pay restitution

WAILUKU — Convicted murderer Steven Capobianco agreed Tuesday to pay $2,699 to resolve a restitution claim in his murder case.

The money would go to the mother of Capobianco’s pregnant ex-girlfriend Carly “Charli” Scott, said 2nd Circuit Judge Joseph Cardoza.

On Dec. 28, after a trial that spanned more than seven months, Capobianco, 27, was found guilty of second-degree murder of Scott and second-degree arson of her vehicle.

He is the last person known to have seen Scott alive, telling police she drove him from Haiku to about 3 miles past Keanae the night of Feb. 9, 2014.

At the time, the 27-year-old Scott was five months pregnant with a son fathered by Capobianco.

On March 24, Capobianco was sentenced to life in prison with the possibility of parole plus 10 years.

The defense had contested the prosecution’s request for restitution of $3,548 for Scott’s vehicle, laptop and cellphone. As part of a plea agreement resolving Capobianco’s other criminal cases, the restitution was settled at $2,699.

In court Tuesday, Judge Cardoza asked Capobianco if he would agree to the lower amount without a hearing.

“I will agree to the amount you’ve noted,” Capobianco said.

Defense attorney Jon Apo said Capobianco wasn’t waiving his right to appeal in the case.

“He’s reserving every right, every grounds to appeal,” Apo said.

Autopsy scheduled to help ID dead man

A man found dead Monday at the bottom of a cliff was in a vehicle registered to a 24-year-old Lahaina man who was reported missing last week, police said.

Justin Sadang was last seen at about 5 p.m. Friday at his residence. He was reported missing the next day when he didn’t return home as he usually did, police said.

Sadang had left home in his gray Toyota 4Runner, police said.

At about 5:30 p.m. Monday, an opihi picker came across the overturned vehicle with the body inside at the bottom of a 100-foot cliff below the Nakalele Point Lighthouse. Firefighters were lowered to the rocky shoreline and extricated the man from the vehicle before his body was airlifted to Kahekili Highway.

Police said family members were unable to identify the body.

An autopsy was scheduled, with an investigation continuing.

Missed trash will be picked up today

A staff shortage disrupted curbside garbage collection Tuesday in Kula, the county Department of Environmental Management announced.

Affected areas included Kula Highway, the Kula Kai Subdivision, Akea and Waimele places and Pulehu, Omaopio, Lower Kula, Piliwale and Holopuni roads. Surrounding streets and roads also were affected, according to the announcement.

Missed pickups were expected to be done today.
