Woman sentenced to probation for use of ex’s credit card

WAILUKU — A Lanai woman who was seen on video using her estranged husband’s credit card was ordered to perform 100 hours of community service as part of one year’s probation.

“The honeymoon phase is over between you and your husband, ex-husband,” 2nd Circuit Judge Rhonda Loo said in sentencing Michele Vergara on Aug. 9. “Definitely, the honeymoon phase is over.”

Vergara had pleaded no contest to fraudulent use of a credit card.

The credit card and $155 cash were missing after Arnold Vergara left his wallet in his van the night of April 8, 2016, said Deputy Prosecutor Jeffery Temas. A few days later, after realizing the credit card was missing, Vergara learned three charges had been made with the card, Temas said.

He said one was at Richard’s Market, where video showed his estranged wife, Michele Vergara, using the card. She admitted to using the credit card but denied taking the missing cash, Temas said.

“Most people would have eventually figured it out because the island is so small,” Judge Loo said.

Vergara was given credit for 42 days she spent in jail — most of that after she was arrested when she didn’t show up for her original sentencing date.

She was ordered to write a letter apologizing to her now ex-husband.
