Owners responsible for maintaining their property

In response to the June 1 letter regarding cane grass growing out of control in Haiku as well as other parts of Maui County, I am happy to give some guidance as I am the county highways lead person on code enforcement.

The responsibility of maintaining the area between the roadway and private property falls upon the individual property owner whose land abuts or adjoins the county roadway. According to Maui County Code 12.02.020: “Every property owner whose land abuts or adjoins a County street shall continually maintain, and keep clean, passable and free from weeds and noxious growths, the sidewalk or shoulder areas which abut or adjoin the owner’s property.”

In the past, the county has conducted mowing and brush cutting along various roadways and now continues to do so only in cases where the adjoining property is agriculturally zoned and 15 acres or larger, as per Maui County Code 12.02.010.

In most cases, these overgrown areas need to be maintained by the adjacent property owner. If they do not maintain, the county can step in and enforce compliance. I understand it’s been a rainy year, but now is the time to get started.
