WAILUKU — A Kahului tax preparer and a Makawao Realtor have been charged with failing to file annual general excise tax returns for multiple years.
James A. Ericson was charged with failing to file returns for 2002 to 2005 in a complaint filed April 15 in Wailuku District Court, according to a news release from the state Department of Taxation. Ericson, who has an office in Kahului, is an accountant and tax preparer known as “The Tax Guy.”
In a separate complaint, the department said Albert V. Chiarella, president of Al Chiarella Inc., is charged with failing to file the company’s general excise tax returns for 2001 to 2005. Chiarella is a Realtor with an office in Makawao. Chiarella’s attorney, Benjamin Lowenthal, said he could not comment on the pending charges on Thursday.
Ericson and Chiarella have court appearances scheduled for May 22 in Wailuku District Court.
Failing to file a return is a misdemeanor. A conviction could result in a fine of up to $25,000, up to one year in jail or probation.
