Free Aerosmith tickets will settle civil suit

‘Band is about the music’; to play Maui concert in fall

WAILUKU - Aerosmith will be performing on Maui and providing free tickets to more than 8,000 ticket buyers to settle a class-action lawsuit over its canceled 2007 concert scheduled for War Memorial Stadium.

Attorneys for the rock band and the 8,356 people who bought tickets for the Maui concert confirmed the settlement. It received preliminary approval Friday from 2nd Circuit Judge Joseph Cardoza.

Honolulu attorney Brandee Faria, representing the ticket purchasers, said the settlement will include cash reimbursements for airfare, lodging and other costs of some ticket purchasers who had planned to travel from other islands for the Sept. 26, 2007, concert.

Those who bought tickets - and later received refunds when the concert was canceled - are eligible to receive free tickets, Faria said.

She said the new Aerosmith concert date on Maui hasn't been determined but will probably be sometime in the fall.

The class-action lawsuit grew out of a civil suit filed on behalf of Honolulu resident Lisa Sanchez and three others who bought tickets and incurred other costs while making plans to attend the concert.

The lawsuit alleged the concert was canceled after the band opted to play at more lucrative venues in Chicago and on Oahu. Because a band member became ill earlier in its tour, Aerosmith rescheduled a show at a much larger venue in Chicago two days before the Maui concert.

Faria represented Sanchez and the other ticket purchasers along with attorneys John Perkin and Jim Bickerton, who are also experienced in class-action lawsuits. "All three of us are very pleased with the outcome," Faria said.

Attorney Jay Handlin, representing Aerosmith, said the band also was glad to reach the settlement.

"The band is about the music," Handlin said. "So they are glad to be able to resolve this in a way that really focuses on connecting or reconnecting the people of Hawaii with the band and its music."

Those who bought tickets to the canceled concert will be notified of the settlement and procedures to claim free tickets and cash reimbursements.
