County’s denial of permits is unacceptable

April 27, 2012
The Maui News

We have been teaching swimming lessons for four years in conjunction with Maui County. Now, without warning, the county has denied us the use of the pools. We have applied for several different kinds of permits and have been denied all of them. Each time it is for a different reason. None of the reasons fall within the scope of the Maui County ordinances, regulations, rules or laws, as far as we can determine.

We received a call from a county official indicating that tour Type IV permit request for the summer has been denied. He stated that the county will only allow Type II (cc) permits. He also indicated that the county will not be allowing swim teams, dive teams, masters programs, water aerobics or any other program to use the pool if coaches or instructors are paid in any way.

We just submitted another request, so we shall see what transpires.

The county is removing every program from the pools for no real reason. Programs should be allowed in the pools. These pools are for our community. We pay taxes for these pools.

We submitted an appeal to the Maui County Board of Variances and Appeals and do not know if this will have any bearing on the latest denial and plan to remove all programs from all pools.

We are hoping community members will be able to assist us in this matter by speaking up. Let the mayor and council members know that this is unacceptable.
