WAILUKU - A Paia man was released from jail Tuesday after being incarcerated for one year, following his arrest last year in a sexual assault investigation.
Originally charged with second-degree sexual assault, Kenji Limes, 24, had pleaded no contest to a lesser charge of first-degree unlawful imprisonment in the June 18, 2011, incident.
Early that morning, a 53-year-old woman living in the same residence as Limes reported waking up to find him in her bedroom, where a 10-year-old girl was also sleeping.
The woman at first thought it was her husband in the bedroom with her, said Deputy Prosecutor Simone Polak. "She was very, very mad," Polak said. "She felt violated."
At the time, Limes was "coming down from a two-day methamphetamine binge and night of heavy drinking that led to and played a significant role in his actions," said defense attorney Andrew Martin.
He said Limes, who lost his job, family and inheritance from his grandmother because of his drug use, wants to get drug treatment.
As part of his sentence, Limes was placed on five years' probation and ordered not to consume alcohol or illegal drugs.
Second Circuit Judge Joseph Cardoza ordered Limes to have no contact with the victim and to participate in sex offender treatment.
In another sentencing Tuesday, a 42-year-old Kahului man was placed on five years' probation for threatening his stepdaughter and girlfriend in separate incidents.
Clint Isomura was given credit for the one year and more than seven months he had spent in jail.
Defense attorney Ben Lowenthal said he believed both cases resulted from alcoholism.
In one case in June 2009, Isomura got into an argument with his stepdaughter and splashed gasoline around the home and on his stepdaughter's 2-year-old child while threatening to burn the house down, said Deputy Prosecutor Mark Simonds. He said the stepdaughter signed a request to withdraw prosecution two months later.
The following year, Isomura grabbed and dragged his live-in girlfriend while she was talking on the phone to a man she knows, Simonds said. He said Isomura got a knife and threatened to kill the woman.
"It's an understatement to say that the defendant's conduct was outrageous," Simonds said.
Isomura said he couldn't justify what he did.
"I am remorseful and sorry for what I have done to the victims," Isomura said in court. "I just hope that they can forgive me, so we can both move on with our lives."
He had pleaded no contest to two counts of first-degree terroristic threatening and abuse of a household member.
Isomura was ordered to have no contact with the victims and to complete a domestic violence intervention program. He was ordered not to consume alcohol or illegal drugs.
