Man arrested, faces trespassing charge

A man who had been issued a notice to stay away from a Kahului business was arrested Tuesday when he returned to the business and allegedly refused to leave.

Caleb Burgess, 35, who gave no local address, was charged with second-degree criminal trespassing and habitual property crime. His bail was set at $1,100.

Police were called to Aloha Island Mart at 50 Pakaula St. shortly before 2 p.m. when a store manager reported that Burgess refused to leave and sat on the curb outside the store, according to a declaration filed in court to support the charges.

Burgess had been issued a one-year notice March 20 prohibiting him from trespassing at the business, according to the declaration. It said Burgess has numerous arrests and convictions for criminal trespassing in the past 10 years.
