State, ranch refusing to open trail despite court order

James Scott Fretz, Maui manager of the Department of Land and Natural Resources, Division of Forestry and Wildlife, is working with Haleakala Ranch to prohibit use of Haleakala Trail. The trial over this trail was finished in 2014 and nothing has been done to open the trail.

The Hawaii Supreme Court’s October 2018 decision in the TMT case reaffirmed the principle that any balancing between public and private purposes must begin with a presumption in favor of public use, access and enjoyment. Mr. Fretz has at least four land management agreements with Haleakala Ranch, so this is understandable but not unforgivable.

Please write your state senator and representative to require Mr. Fretz to open up Haleakala Trail.
