WAILUKU - A Molokai man is serving a one-year jail term after being arrested on allegations that he had sexually assaulted a girl a few years earlier.
Clarence Stevens Jr., 29, also was placed on five years' probation as part of his sentencing Jan. 9.
He had pleaded no contest to two amended charges of second-degree assault as well as second-degree terroristic threatening of the girl.
She was 10 or 11 years old when Stevens sexually assaulted her between July 2009 and July 2011, said Deputy Prosecutor Iwalani Mountcastle. The girl was asleep in her bed when she was awakened by Stevens, who pulled off some of her clothing and began sexually assaulting her, she said.
The girl told Stevens to stop and kicked him off, but he continued trying to sexually molest her, Mountcastle said. When Stevens finally got off the girl, he told her he would kill her if she told anyone, she said.
That was why the girl didn't immediately report what happened, the prosecutor said. "She was scared of the defendant."
Deputy Public Defender Wendy Hudson said that the plea agreement took into consideration the late reporting and lack of physical evidence.
Mountcastle recommended that Stevens be required to undergo sex offender treatment, based on the facts in the case.
Hudson said that an anger management program would be more appropriate based on the charges.
Second Circuit Judge Peter Cahill said that the plea agreement was fair, taking into consideration potential weaknesses in the prosecution's case and the difficulties associated with allegations of child abuse.
Cahill ordered Stevens to participate in both sex offender treatment and anger management programs. Stevens also was ordered to have no contact with minor children unless approved by his probation officer.
Stevens was placed on probation in another case for third-degree promotion of a dangerous drug and unauthorized control of a propelled vehicle. He had pleaded no contest to the charges in connection with his arrest Aug. 19, 2012, in Iao Valley in Wailuku.
Stevens was seen with a parked moped that turned out to have been stolen two months earlier, and he had a packet containing crystal methamphetamine, Mountcastle said.
