WAILUKU -- A one-year jail term has been ordered for a Molokai man who was convicted of burglarizing his ex-girlfriend's residence and assaulting a police officer.
Jesse Alika Beamer, 40, also was placed on four years' probation when he was sentenced Thursday.
Noting that Beamer's compliance had been described as "marginal" when he was previously placed on probation, 2nd Circuit Judge Richard Bissen said the defendant could face more incarceration if he doesn't follow court requirements.
"If you violate, the only other sentence available to you is prison," Bissen said.
In two cases, Beamer had pleaded no contest to a reduced charge of second-degree burglary, first-degree assault on a law enforcement officer, first-degree terroristic threatening and abuse.
In the burglary case, a Kaunakakai woman returned home Feb. 20, 2016, to find her ex-boyfriend Beamer in the garage spraying windows with a hose, said Deputy Prosecutor Kerry Glen. She said the woman asked Beamer to leave, and he got a ride with someone passing by before getting out of the car one-tenth mile away and running toward brush.
The woman found doors in her home opened and a phone with a shattered screen on the bed, Glen said.
Several months later, on Aug. 8, 2016, Beamer had been arrested for violating an abuse warning citation involving the same ex-girlfriend when he kicked a police sergeant in his inner thigh and threatened to hurt the sergeant after being released, Glen said.
She said Beamer has prior convictions for abuse in 2012 and second-degree terroristic threatening last year. He was accused of threatening his aunt with a sledgehammer in an Oahu case that was dismissed without prejudice (meaning charges could be brought again) after a mistrial this year, Glen said.
"It is clear that the defendant has a history of violence," she said.
She recommended the one-year jail term for Beamer, who sought to be released after already spending several months in jail.
In the burglary case, Beamer's ex-girlfriend had provided a statement saying her son had let Beamer into the home that day, said Deputy Public Defender Nikki List.
She said Beamer had completed anger management treatment after being arrested. "He does recognize he has anger issues that he needs to resolve," she said.
Speaking in court Thursday, Beamer's mother said she would supervise him if he were released.
"He has a good heart," she said. "He just has a bad temper.
"Part of it is my fault for being a mom who spoiled him."
She said she had paid his bills but didn't bail him out this last time. She said he would be paying child support for his four children and would be paying her back.
Judge Bissen said Beamer was lucky to have his mother in his life.
"He won't know that for some time," Bissen said. "He's taken you for granted and has taken advantage of you. He's learning his lessons late in life. It's a late lesson, but it's a good lesson. He's used to getting his way."
