A 46-year-old Kahului man was sentenced to one year in jail and five years' probation on Tuesday for choking a female family member in June.
Second Circuit Court Judge Peter Cahill ordered Rodney Cabudol to serve 90 days in jail before he is able to enter a residential substance abuse program. The jail sentence went beyond a plea agreement, which called for 21 days in jail with credit for time served.
Cabudol also will need to enter and complete a domestic violence intervention program, Cahill said. He also will receive credit for the 21 days he already served.
Cahill said he recognizes that substance abuse is a factor in the case but is concerned that the violence could be repeated because Cabudol has a prior history of abuse. The defendant's substance abuse doesn't diminish Cabudol's effects on others, the judge said.
During sentencing, Cabudol apologized for his actions.
"Sorry for everything I've done. I recognize the people that I hurt," he said. "I'm motivated to do better."
Deputy Public Defender Jeffrey Wolfenbarger said Cabudol's issues stem from drug addiction, which he is working on. He said Cabudol also is trying to get into Aloha House for substance abuse treatment.
Daniel Rice, a King's Cathedral Maui pastor, said he is working with Cabudol and the victim. Rice said he would be willing to take Cabudol into his program that helps those with addiction through mentoring, working, attending meetings and being part of society along with a spiritual component.
Cabudol pleaded no contest to felony abuse of a family or household member for an incident on June 17.
