WAILUKU - A Lahaina man who was released from prison several months before he used a stolen credit card and committed other crimes has been sentenced to a five-year prison term.
Marlie Boy Viloria Jr., 34, was ordered to pay $1,611 in restitution as part of his sentence imposed Thursday.
"We're dealing with someone who really cannot live in the community and be law abiding," said Deputy Prosecutor Mike Kagami, who argued for the prison sentence.
In four criminal cases, Viloria had pleaded no contest to credit card theft, fraudulent use of a credit card, attempted second-degree theft, first-degree bail jumping, second-degree theft and abuse.
The crimes occurred from April to September 2018, according to court records.
In 2006, Viloria had been given a chance to keep convictions off his record when he was sentenced for credit card theft and fraud. Four years later, he was arrested for committing another felony offense, his deferral was revoked, and he was placed on probation for the crimes.
Kagami said Viloria committed additional crimes while on probation.
In 2013, he was sentenced to five years in prison for second-degree burglary, four counts of credit card theft and fraudulent use of a credit card.
Kagami said Viloria was denied parole and served the full sentence.
Viloria was released from prison Aug. 4, 2017, and had been doing well while living with his mother and working, said his attorney, Cody Minatodani.
"The trouble started when he started using drugs again," she said.
While in jail and awaiting sentencing, Viloria had applied for admission into drug treatment programs, Minatodani said.
"He so wants a chance on probation," she said.
She noted that Viloria wasn't charged with breaking into the vehicle that the credit card was stolen from.
In a letter to the court, Viloria apologized for what he did to the victims.
Second Circuit Judge Peter Cahill said it was "excellent" that Viloria was trying to make changes in his life.
In imposing the prison sentence, Cahill noted that Viloria had been denied parole several times and committed the offenses shortly after being released from prison.
