WAILUKU -- A woman charged with murder in the death of a 51-year-old homeless man was seen striking him in the head several times Sunday night in the McDonald's restaurant parking lot in Lahaina, according to an affidavit filed in court.
Bail was kept at $500,000 for Heather Glennon, 46, when she appeared Thursday in Lahaina District Court convening in Wailuku.
"The state does consider her a flight risk," Deputy Prosecutor Lewis Littlepage said. "She appears to have only been on the island about a year and does not appear to be employed."
Glennon was arrested after Lahaina patrol officers were dispatched to investigate a report of suspicious activity at 7:23 p.m. Sunday at the restaurant at 885 Wainee St. Police said the man was found lying on the ground, and Glennon was seen walking in and out of traffic on the road.
Originally arrested for disorderly conduct, Glennon was charged with second-degree murder after the man died Tuesday, police said.
He was identified in court documents as Christopher Flanagan.
According to the affidavit, the assault on Flanagan stopped Sunday night when a McDonald's employee walked toward him and Glennon. He crawled away and ended up near a light post on a curbing adjacent to the restaurant drive-thru, the affidavit says.
Flanagan initially was reported to be in stable condition. As he was being transported by ambulance to Maui Memorial Medical Center, medics reported he was having difficulty breathing and his condition was changed to critical, according to the affidavit.
He was pronounced dead Tuesday morning at the hospital.
In court Thursday, Glennon asked to be released on supervision or her own recognizance based on her lack of criminal history on Maui, said Deputy Public Defender Gustavo Gonzalez.
Littlepage said Glennon has convictions for two counts of disorderly conduct, indecent exposure, drinking in public, second-degree criminal trespassing and contempt of court. She also is pending trial on charges of open lewdness, two counts each of disorderly conduct and drinking liquor on a public highway or sidewalk and contempt of court, court records show.
Judge Douglas Sameshima kept bail at $500,000 for Glennon. She was ordered not to consume alcohol or illegal drugs and not to leave Maui without permission from the court if she makes bail.
