Man awaiting trial for attempted murder allowed to leave state

He will be required to live with a relative and wear a monitoring device

WAILUKU — A man awaiting trial in an attempted murder case was allowed to leave the state after $110,000 bail was posted in his case.

Danny Bennett, 73, was required to live with his sister in Jerseyville, Ill., and wear a GPS monitoring device as part of his release from jail June 18.

He previously was being held without bail after being indicted on charges of second-degree assault, two counts of abuse, attempted first-degree murder, felony abuse, intimidating a witness and first-degree terroristic threatening. He has pleaded not guilty to the charges alleging he assaulted his 77-year-old wife Nov. 7 and Jan. 21 at their residence in Kihei.

He allegedly hit her on the head with a wine bottle, causing lacerations, in the first incident. The second time, he allegedly threatened to kill her while holding a knife and strangled her from behind with a washcloth, according to the prosecution.

Second Circuit Judge Peter Cahill set bail and conditions for Bennett’s release at a hearing June 15.

A trial had been set to begin next month, but Cahill said police had turned over additional material in the case to the prosecutor’s office, requiring more work by attorneys before a trial.

In addition, Cahill said changing COVID-19-related regulations issued by the state Department of Health have led to uncertainty about whether inmates will be transported to court on any given day.

He said Bennett wasn’t transported to the courthouse for a pretrial hearing several weeks earlier.

“We just have no guarantees,” Cahill said.

He said concerns by the court and the prosecution about the danger Bennett might pose could be addressed by having Bennett go to the Mainland to live with family members. He was required to post $10,000 in cash and a $100,000 bond to be released from the Maui Community Correctional Center.

His attorney, Matthew Nardi, drove Bennett from the Wailuku jail to Kahului Airport to take a flight to Los Angeles.

Bennett was required to stay in the town of Jerseyville, except for medical appointments. He was ordered to have no contact with his wife and her sons.

Bennett was ordered to return to Maui for his trial, which is set for April 11.
