WAILUKU -- A man was arrested after he allegedly was "disorderly and aggressive" toward a police officer who asked him to leave a Wailuku store Saturday.
Wayne Ohls, 37, who gave no local address, was charged with second-degree criminal trespassing, habitual property crime and attempted third-degree assault.
The manager of Safeway on Maui Lani Parkway called police shortly after 2 p.m. Saturday to report that Ohls was trespassing in the store and became combative when asked to leave, according to a declaration filed in court to support the charges.
"He was given many, many opportunities to leave the store where he was asked in a peaceful manner," Deputy Prosecutor Jeffery Temas said during Ohls' initial appearance Monday in Wailuku District Court. "He refused and instead attempted to assault a police officer. He was combative during the apprehension."
According to the declaration, Ohls "became disorderly and agressive" toward an officer and tried to punch him in the face multiple times. The officer suffered a fractured finger, Temas said.
In asking for bail to be increased from $1,100 to $5,000 for Ohls, Temas said the defendant faces mandatory jail time if convicted as charged of habitual property crime, a felony offense that can be brought when an arrestee has two felony or misdemeanor convictions within 10 years.
Ohls has 40 convictions, including 16 for contempt of court and two for failure to appear, Temas said.
Deputy Public Defender Lindsay Lipp asked for Ohls to be released on supervision. She said he was set to receive mental health housing services and Social Security checks.
Judge Blaine Kobayashi cited Ohls' "extensive criminal history, including the extensive criminal history of failing to appear in court," in increasing bail to $5,000.
Ohls was ordered to stay away from the Safeway store, employees and the police officer who was injured.
