State aims to shut down Ulta Lab Tests collecting depots on Maui

The Hawaii Department of Health has issued a Notice of Violation and Order against John Roehm, the CEO of Ulta Lab Tests, for allegedly providing direct-to-consumer laboratory testing to Hawaii consumers in violation of state law.

According to the department, Ulta Lab Tests is affiliated with two laboratory test and health care sites on Maui where specimens have been collected directly from individuals without a request from an authorized person, as required under the law.

The department says Ulta Lab Tests is not a clinical laboratory certified under federal law and does not meet state requirements to establish collecting depots in Hawaii.

The state has ordered Ulta Lab Tests to end its affiliations with Maui Midwifery in Wailuku and Maui Longevity Rx in Paia, as well as Lab Exodus, which is a mobile phlebotomy service on Kauai. The three entities were also ordered to cease operations as collection depots for Ulta Lab Tests and fined $15,000.

Ulta Lab Tests, Lab Exodus, Maui Midwifery and Maui Longevity Rx have 20 days to submit a written request for a hearing or the order will become final and enforceable after the 20-day period.
