Bail reduced to $6,000 in fatal crash

WAILUKU — A 2nd Circuit judge reduced bail to $6,000 for a 24-year-old Haiku woman, who is charged in a crash that killed a Texas woman in June 2019 in Haliimaile. 

Judge Kelsey Kawano on Thursday lowered bail from $234,000 to $6,000 cash only for Kailey Amber Duarte.

She is charged with one count of manslaughter, three counts of negligent injury in the first degree and negligent injury in the second degree in the crash on June 16, 2019, on Haliimaile Road.

Teresa Pham, 39, of Spring, Texas, died in the crash.

A bail study recommended supervised release, noting Duarte’s ties to the community. Deputy Prosecutor Brandon Segal, who heads the prosecutor’s new Vehicular Homicide and Road Safety Unit, objected to the lower amount.

Segal said Duarte poses a danger to the community if driving.

He said that she did not learn from her past, which includes being a passenger in a vehicle that was involved in a fatal crash in 2016 and being arrested for DUI.

In addition to Pham’s death in the current case, Segal said Duarte also caused significant injury to others, including Pham’s fiance.

Deputy Public Defender Ben Lowenthal said that Duarte’s family will be able to afford the $6,000 cash bail and had participated in the bail study.

Lowenthal said that Duarte also suffered injuries in the crash and was awaiting hernia surgery, which has a six-month recovery time.

He said the medical procedures had been ongoing prior the grand jury indictment last week.

If Duarte is released, Kawano said she must follow the standard conditions of bail including checking in with the Maui Intake Service Center, not using alcohol or illicit drugs and reporting for substance abuse testing in two hours if required.

Duarte also will be required to wear a 24-hour alcohol monitoring device bracelet from SCRAM Hawaii, which needs to be in place within the next two weeks.

She also was ordered not to drive.

Duarte’s pretrial conference is scheduled for Aug. 31.
