Men allegedly found with drugs, loaded pistol arrested

WAILUKU — Two men were arrested in Wailuku town last week when police reported finding them in a vehicle containing drugs and a loaded pistol.

Nolan Fraser, 35, of Lahaina and Isaac Pahulu, 24, of Kihei are each charged with possession of a firearm in the commission of a felony drug offense, carrying a loaded firearm on a public highway, first-degree promotion of a dangerous drug, attempted first-degree promotion of a dangerous drug, second-degree promotion of a dangerous drug, two counts of possessing drug paraphernalia, third-degree promotion of a detrimental drug and promoting a controlled substance near a school.

In addition, Fraser is charged with being a felon in possession of a firearm, being a felon in possession of ammunition, two counts of third-degree promotion of a dangerous drug, three counts of possessing drug paraphernalia and third-degree promotion of a detrimental drug.

During the defendants’ initial appearances Tuesday in Wailuku District Court, Deputy Prosecutor Tracy Jones asked that bail remain at $500,000 each for Fraser and Pahulu.

Fraser was driving and Pahulu was a passenger in a vehicle that had gone through the McDonald’s drive-thru May 12 with a firearm loaded with six rounds of ammunition, including one bullet in the chamber, Jones said.

After the vehicle was stopped, a K-9 alerted to the presence of drugs, leading to the seizure of more than 1 ounce of methamphetamine, Jones said. In a backpack in the area where Pahulu was sitting, police reported finding several packets of methamphetamine, Jones said. She said two larger packets of the drug were found in the cup holder area.

In the back seat, police reported finding a methamphetamine pipe, counterfeit oxycodone pills containing fentanyl and marijuana belonging to Fraser, Jones said.

Fraser and Pahulu were arrested during daytime hours in the vehicle that was within 750 feet of The Hawaii Technology Academy charter school on Main Street, Jones said.

“This conduct presents an extreme danger to the community, that they were driving around with a large amount of methamphetamine and a loaded firearm,” she said. “They were brazen enough to do it in town in the McDonald’s area parking lot.”

Fraser was being sought on a warrant alleging he violated his probation for attempted second-degree theft and second-degree criminal property damage. He had contacted police to say he was going to turn himself in but hadn’t done so, Jones said.

She said Fraser has an “exceptional” criminal record of 60 convictions, including five for felony offenses, 32 for misdemeanors and 23 for other offenses. He has been convicted of contempt of court more than 20 times and also has convictions for violent crimes, including two counts of first-degree assault on a law enforcement officer, Jones said.

“He is a dangerous felon armed with drugs and a firearm in the community within 750 feet of a school,” she said.

Deputy Public Defender William Pannell asked for lower bail for Fraser and Pahulu.

Judge Kirstin Hamman kept bail at $500,000 for Fraser.

“The court is concerned about the danger to the community,” she said.

Judge Blaine Kobayashi kept bail at $500,000 for Pahulu.

He was ordered not to consume or possess alcohol or illegal drugs and not to be with anyone possessing illegal drugs or alcohol.

Fraser and Pahulu were ordered to have no contact with each other.
