What began as a nighttime fishing trip resulted in a Maui man being charged with possession of marijuana and illegally fishing with a drone.

According to the Department of Land and Natural Resources, the 37-year-old man from Kihei was booked and later released after posting $600 in bail. He is scheduled to appear in Wailuku District Court on May 8.

On Sunday, an officer from the state Division of Conservation and Resources Enforcement was contacted by Maui Police dispatch about an anonymous complaint of someone fishing using a drone.

According to the department, the responding officer found the man to be in possession of what appeared to be marijuana. The officer also observed drug paraphernalia in open view on a table attached to his chair including a glass bong, loose marijuana in a clear glass jar and in a plastic package, and a yellow wax-like substance.

The substances in the packages and containers were field tested, and produced positive results for marijuana, hashish and marijuana concentrate, according to the department.

The man was arrested on promotion of a detrimental drug in the second degree and two charges of promotion of a harmful drug in the fourth degree.

During the investigation, the officer also reported spotting a drone lying in the sand.

The fisherman allegedly admitted to using the drone to cast his fishing line and was cited for possession or use of an unmanned aerial vehicle on, in or near state marine waters.

The drone apparently was used to drop a baited hook in the water — an action requiring a permit if done over state marine waters.

Fishermen typically use an inflatable or surfboard to paddle out to drop off baited hooks with floaters and lines connected to fishing poles on the shoreline.
